Chief Justice Roberts read the verdict at approximately 10AM this morning. Healthcare Reform, including the individual mandate is constitutional and the law stands. Surprisingly the Chief Justice sided with the liberal justices. In the 5-4 decision authored by the Chief Justice, the Court found that the individual mandate provisions of PPACA are constitution as a tax. “Our precedent demonstrates that Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it.” read more

Summary of Benefit Coverages, New Effective Date: September 23, 2012

The Agencies have issued final regulations and related guidance on PPACA’s benefit summary requirement. Employers must start finalizing these summaries with their health plan insurers to be ready for the new September effective date. Note this requirement also applies to grandfathered plans. read more
